Portrait rights declaration for clients and visitors

Hereby grants permission to Sunfer Estructuras S.L.U for the use of his/her image in any and all media and communication materials and publications, including but not limited to:

• Company’s website and web pages.
• Company profiles on social networks.
• Marketing and promotional materials, including brochures, webinars, flyers, posters and advertisements.
• Press releases and other press releases.
• Internal presentations and reports, including instructional videos and physical training sessions.

Client/visitor consent is detailed below.

Article 1 – Use of image

1.1 By signing this document, the client/visitor declares, without reservation, to give permission to Sunfer Estructuras S.L.U. to make (or have made) recordings/images of him/her, and to use them for the following purposes:

• Marketing and promotional materials.
• Corporate website and social media platforms.
• Internal communications and publications.
• External publications and advertising.
• Any other business-related purposes.

1.2 The client/visitor agrees to the use of their image, worldwide, perpetual, and royalty-free, in the broadest sense, by Sunfer.

1.3 The client/visitor expressly acknowledges that the right of use and permission granted in this article covers all possible current and future forms of exploitation, including, but not limited to, online or face-to-face training purposes, dissemination on social media, website or various materials promoting Sunfer trainings.

1.4 The client/visitor hereby agrees that the foregoing shall apply in its entirety, even if the business relationship is terminated or terminated at any time, unless the client/visitor indicates otherwise in writing.

1.5 The client/visitor acknowledges that he/she has signed this declaration of his/her own free will and understands that he/she has the right to withdraw his/her consent in writing at any time. However, the withdrawal of consent shall not apply to any material using his/her image, previously made by Sunfer Estructuras S.L.U.

1.6 Sunfer acknowledges that it will only use the employee portrait in accordance with the General Data Protection Regulation (GDPR) and the Copyright Act.

Article 2 – Copyright

The client/visitor confirms that he/she understands that he/she has no copyright (including ownership) on the recordings or photographs taken. These belong to Sunfer Estructuras S.L.U. Furthermore, the client/visitor confirms that he/she understands that he/she cannot claim financial compensation for the use of his/her portrait, as this use takes place within the regular activities of Sunfer. The customer/visitor declares not to exercise his rights under article 21 of the Copyright Act (portrait right).

Article 3 – Privacy

Sunfer Estructuras S.L.U., respects the privacy of the client/visitor, as well as the obligations arising from the General Data Protection Regulation (GDPR). Sunfer will at no time provide information to third parties to the extent that this is not necessary for the execution of the order.
